In consideration of being allowed to participate in a weight-bearing exercise or resistance training exercise and the OsteoStrong® exercise system as provided by OsteoStrong® and OsteoStrong® franchises, subject only to the statutory rights and implied warranties which cannot be excluded, I do hereby waive, release and forever discharge OsteoStrong Franchising, LLC, its officers, affiliates, subsidiaries, parent companies, owners, agents, employees, representatives, executors, anyone acting on behalf of OsteoStrong® , and all others, and OsteoStrong® franchisees, their officers, affiliates, subsidiaries, agents, employees, representatives, executors and all others (“OsteoStrong® representatives”) from any and all responsibilities or liabilities from injuries or damages arising out of or connected with my participation in any program or service offered by OsteoStrong®, or any OsteoStrong® franchise, and/or my attendance at any OsteoStrong® demonstration or event, or OsteoStrong® franchise, including my participation in all activities, my use of equipment and/or machinery, passive or active, any omission or commission, including any liability arising from the negligence of OsteoStrong® representatives anywhere, including, but not limited to, any premises owned, operated, controlled and/or leased by OsteoStrong® representatives. I understand and am aware that participating in a weightbearing exercise or resistance training exercise program or the OsteoStrong® exercise system, including the use of Spectrum equipment, X-3 Bar, vibration plate, PEMF mat, Biocharger®, cryotherapy, Hydromassage® or any other equipment made available by OsteoStrong®, are potentially hazardous activities. I acknowledge that I am voluntarily participating in these activities and using equipment and machinery with knowledge of the dangers involved. Subject only to the statutory rights and implied warranties which cannot be excluded, I hereby agree to expressly assume and accept any and all risks of injury or death in respect of myself and caused directly by me or as a result of my conduct, omissions or negligence to others. I hereby further agree to expressly assume all responsibility for any injury or death caused directly or indirectly through my conduct, omissions operated, controlled and/or leased by OsteoStrong® representatives. I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation or use of equipment or machinery and/or my participation in any programs or services offered at any OsteoStrong® event or any OsteoStrong® franchise. I do hereby acknowledge that I have been informed of the need for a medical practitioner’s approval for my participation in any program provided by OsteoStrong® or OsteoStrong® franchises and in the use of exercise equipment and machinery. I also acknowledge that it has been recommended that I have a yearly or more frequent physical examination and/or consultation with my physician as to physical activity, exercise, use of exercise and training equipment and participation of any program at any OsteoStrong® event or OsteoStrong® franchise so that I might have his/her recommendations concerning these fitness activities and equipment use. I acknowledge that I have either had a physical examination and been given my medical practitioner’s permission to participate in the physical activity, exercise, use of exercise and training equipment and participation of any program of any OsteoStrong® event or OsteoStrong® franchise or that I have decided to participate in the physical activity, exercise, use of exercise and training equipment and participation of any program of any OsteoStrong® event or OsteoStrong® franchise without the approval of my physician and do hereby assume, subject only to the statutory rights and implied warranties which cannot be excluded, all responsibility for my participation in the physical activity, exercise, use of exercise and training equipment and participation of any program of any OsteoStrong® event or OsteoStrong® franchise. OsteoStrong® may film or photograph me while trying the OsteoStrong® equipment during events. I hereby assign and grant to OsteoStrong® representatives the right and permission to use and publish the photographs, film, videotapes, electronic representations and/or sound recordings made of me by OsteoStrong® representatives, and I hereby release OsteoStrong® representatives from any and all liability from such use and publication. I give OsteoStrong representatives the right to use my name, likeness and biographical material to publicize the program and the services of OsteoStrong franchises for social media and website usage. I specifically waive any right to any compensation I may have for any of the foregoing. I consent to receiving text and email communication regarding OsteoStrong® products and services and from other partners of OsteoStrong®.
